Partner Abigail Healey comments on recent Supreme Court ruling on malicious falsehood claims in Law360

Section 3(1) of the Defamation Act 1952 was enacted to make it easier for claimants to recover damages in malicious falsehood by introducing a presumption of financial loss (in certain circumstances). Yet the Supreme Court in George v Cannell has held that in order to recover damages for injury to feelings under s3(1), a claimant must prove they have in fact suffered financial loss.
